1. Acceptance
By creating a LiftUp account, accessing or using the Service, or by clicking "I agree", you agree to be bound by these Terms and our Privacy Policy. If you are entering into these Terms on behalf of an organization, you confirm you have authority to bind that organization.
2. Eligibility
You must be at least 18 years old to use LiftUp. The Service is intended for use by businesses and organizations.
3. Account & security
You are responsible for your account credentials and for activity that happens under your account. Keep your password and API keys confidential, enable two-factor authentication, and notify us immediately of any suspected unauthorized access.
4. Acceptable use
You agree not to:
- Use the Service in violation of any applicable law
- Send unsolicited communications (spam), or content that is illegal, harmful, defamatory, or infringes the rights of others
- Upload malware, attempt to gain unauthorized access, or interfere with the Service or other tenants
- Reverse engineer, decompile, or scrape the Service beyond what is permitted by our APIs
- Resell or sublicense the Service outside of an Enterprise white-label arrangement we have agreed to in writing
5. Subscriptions & billing
Paid subscriptions renew automatically at the end of each billing cycle until cancelled. Fees are billed in advance through Razorpay. You authorize us and our payment processors to charge your payment method.
Applicable taxes (including GST in India where applicable) may be added to your invoice. You are responsible for ensuring the billing information you provide is accurate.
6. No refunds
All fees paid for LiftUp are non-refundable.
Subscription fees, add-ons, and one-time purchases are non-refundable, including for partial billing periods, unused capacity, or downgrades within a paid period. You can cancel your subscription at any time to stop future renewals; access continues until the end of the period you have already paid for.
Where a refund is mandated by applicable consumer-protection law that cannot be excluded, we will honor only what that law strictly requires.
7. Trial and Free plan
The 14-day Growth trial is available to eligible new customers and unlocks Growth features for the trial period. No credit card is required to start. When the trial ends, your workspace settles to the Free plan unless you have upgraded; we never auto-charge you at the end of a trial.
8. Customer content & lead data
You retain all rights to content and data you submit to LiftUp ("Customer Content"), including leads captured into your CRM, blog posts, and uploaded media. You grant us a worldwide, non-exclusive license to host, process, transmit, and back up Customer Content solely to provide the Service to you.
You are responsible for Customer Content, for obtaining any consents required from individuals whose data you submit (for example, contacts submitting lead forms), and for ensuring you have the right to use it with LiftUp.
9. Our service & changes
We continuously improve LiftUp and may add, change, or remove features. We will not materially reduce the core functionality of a paid plan during a billing period without notice.
10. Third-party services
LiftUp integrates with third-party services such as Google APIs (Analytics, Search Console, Gmail, Calendar), Razorpay, and OpenAI-compatible AI providers. Your use of those services is governed by their own terms. We are not responsible for third-party services or outages outside our control.
11. Intellectual property
The Service, including the LiftUp software, documentation, and brand, is owned by QalbIT Infotech and our licensors. Except as expressly permitted, you may not copy, modify, distribute, or create derivative works of the Service.
12. Confidentiality
Information either party shares that is marked or reasonably understood as confidential must be protected with the same degree of care the receiving party uses for its own confidential information, and at least reasonable care.
13. Suspension & termination
You can stop using LiftUp at any time. We may suspend or terminate your access if you breach these Terms, present a security or legal risk, or if required by law. On termination, your right to use the Service ends; previously paid fees remain non-refundable.
14. Disclaimers
The Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that all defects will be corrected.
15. Limitation of liability
To the maximum extent permitted by law, neither party will be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, goodwill, or data. Our aggregate liability under these Terms will not exceed the fees you paid us in the 12 months preceding the event giving rise to the claim.
16. Indemnification
You agree to defend, indemnify, and hold harmless QalbIT Infotech and its officers, directors, and employees from claims arising out of your use of the Service in breach of these Terms or applicable law, including claims related to Customer Content.
17. Governing law & jurisdiction
These Terms are governed by the laws of India, without regard to its conflict of laws principles. The courts located in India shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, subject to mandatory consumer-protection laws of your country of residence.
18. Changes to these Terms
We may update these Terms from time to time. We will notify you of material changes in-app or by email. Continued use of the Service after changes take effect constitutes acceptance.
